Supreme Court stays Rahul Gandhi’s conviction in defamation case

New Delhi: The Supreme Court on Friday stayed the two-year jail term awarded to Congress president Rahul Gandhi in the Modi surname case. During this, the court asked why the maximum punishment in this case? He said he could have been given a lesser sentence. They are not disqualified. The sentence could have been 1 year and 11 months.


Earlier, the debate went on for 3 hours in the Supreme Court. Rahul’s lawyer said that Purnesh Modi, who filed the defamation case, has changed his surname and not his real surname Modi. On behalf of Rahul Senior advocate Abhishek Manu Singhvi argued the case. “The real surname of complainant Purnesh Modi is not Modi. He adopted this surname later.
Not a single person filed a case for mentioning Gandhi’s name in his speeches. This is a small Modi community of 13 crore people. There is no uniformity. Among them, those who are angry with Rahul’s statement and are filing cases are in the BJP office. That’s surprising.
The case was heard by a bench of Justices BR Gavai, PS Narasimha and Sanjay Kumar. Rahul Gandhi has demanded a stay on his sentence. The Gujarat High Court had refused to stay Rahul’s two-year sentence in the defamation case.
Before the hearing began, the Supreme Court told Abhishek Manu Singhvi- You have to prove this case special to stop the sentence, otherwise the ruling is usually applicable.
