New Delhi:The Chief Justice should be reinstated in the committee for the appointment of three national election commissioners. A public interest litigation has been filed in the Supreme Court. Which directly challenged the law brought by the Centre.
In a landmark verdict in March, the Supreme Court ruled that the cabinet would not have the exclusive power to appoint the chief election commissioner and election commissioners. They will be appointed by a joint committee of the Prime Minister, the Leader of the Opposition and the Chief Justice. The President will appoint the Election Commissioners as per the recommendations of this committee. If there has never been a Leader of Opposition in the Lok Sabha, then the leader of the largest opposition party.
