Gauhati HC Supports Demolition of Unauthorised Building in Dhubri After Legal Dispute

The Gauhati High Court upheld the Dhubri-Gauripur Development Authority’s order to demolish an unauthorised building in Jhagrarpar. The structure was removed after the owner failed to prove legal permission for its construction.

Guwahati: The Gauhati High Court has upheld the decision of the Dhubri-Gauripur Development Authority (DGDA) to demolish an unauthorised building in Jhagrarpar, Dhubri, after the owner, Habibar Mollah, was unable to provide legal construction approval. The demolition of the structure took place on January 29, following the court’s ruling.Mollah had previously challenged the demolition notice (DGDA/PG/45/Pt-I/2015/171) issued by the DGDA on January 1, 2024. The notice alleged that Mollah had built the structure without securing the necessary permissions, classifying it as illegal and ordering its removal.During legal proceedings, the Gauhati High Court pointed out the lack of evidence showing that Mollah had obtained any construction approval from the DGDA, despite the fact that the building stood in an area under the authority’s jurisdiction.As part of its ongoing efforts to address unauthorised constructions in rural areas, the DGDA conducted an eviction drive at the Jhagrarpar Link Road. Mollah’s property was one of the key targets in this operation.Tutul Roy, the Head Assistant of DGDA, confirmed that three notices had been sent to Mollah, urging him to demolish the building, but he failed to comply. With the court’s approval of the DGDA’s order, the building was eventually demolished.The Dhubri-Gauripur Development Authority reiterated its dedication to ensuring urban planning regulations are followed and to preventing illegal construction within its jurisdiction.
