Gujarat HC to hear Rahul Gandhi’s plea in ‘Modi’ defamation case

New Delhi: On Tuesday, Rahul’s lawyer BM Mangukia had moved the High Court seeking a stay on the surat sessions court’s order to execute the sentence. This hearing is based on that.

The Gujarat High Court is all set to hear Rahul Gandhi’s plea challenging the surat sessions court’s verdict in the contempt of Modi title case. A bench of Justice Hemant Prachanda will hear the matter on Saturday morning.

On Tuesday, Rahul’s lawyer BM Mangukia moved the High Court seeking a stay on the surat sessions court’s order to execute the sentence. The petition was listed for hearing before a bench headed by Justice Gita Gopi. Justice Gopi of the Gujarat High Court recused himself from hearing the case. When Rahul’s lawyer PS Champaneri sought an early hearing of the petition, Justice Gopi said, “Not to me. He directed the Registrar of the High Court to send the case back to the Chief Justice.
The case then went to a bench headed by Justice Hemant. On March 23, Judge HH Verma of surat magistrate’s court in Gujarat sentenced Rahul to two years in jail for making objectionable remarks by using the surname ‘Modi’ in Kolar, Karnataka, during the 2019 Lok Sabha election campaign. The judge, however, allowed rahul’s bail plea in the “criminal defamation” case and gave him 30 days to appeal against the verdict in a higher court.
