New Delhi: Leaving home without any reason. Not trying to maintain good relations with the in-laws, not behaving well with the husband is actually cruelty. The Delhi High Court has granted divorce to a couple on this ground.
An elderly man has filed a divorce case in the Delhi High Court, accusing his wife of cruelty. He alleged that his wife used to go to her parents’ house at regular intervals without any valid cause. He also did not accuse his in-laws of misbehaving with him. It’s actually cruelty.

The couple married in 1992. She filed for divorce in the family court in 2017. After five years of litigation, the family court dismissed the divorce case. He then approached the Delhi High Court. In the affidavit, he said that his wife is restless. She left him at least six times for no reason. Sometimes she even claims to be a widow. However, the woman’s lawyer opposed the claim and claimed that she was subjected to humiliation by her in-laws. Her mother-in-law did not treat her well.
A division bench of Justices Suresh Kumar Kait and Neena Bansal Krishna said, “It is not justified for the husband to leave the house frequently. It’s actually a kind of cruelty. Moreover, the woman did not try to improve the relationship with her in-laws in a long-term marriage. On this ground, the court allowed the separation.
