‘Husband begs professionally, but wife’s maintenance is his responsibility’: Court in divorce case

New Delhi:”It is the ideological responsibility of a husband to provide for his wife, even if the husband begs professionally,” the court said. “The husband (in this case) is a capable person, a labourer also earns Rs 500 or more a day. ’

The case was a divorce. There, a lower court ordered a man to pay Rs 5,000 per month to his wife for maintenance during the divorce case. He has approached the Punjab and Haryana High Court challenging the order. The Punjab and Haryana High Court has made it clear that even if a husband begs professionally, it is his responsibility to provide for his wife.
“It is the ideological responsibility of a husband to provide for his wife, even if the husband begs professionally,” the court said. “The husband (in this case) is a capable person, a labourer also earns Rs 500 or more a day. In the case in which the court gave the verdict, the petitioner’s wife had filed a divorce case under Section 24 of the Hindu Marriage Act. In her petition filed in the lower court, she demanded Rs 15,000 per month from her husband. He also demanded Tk 11,000 for litigation expenses. The court then said that the man would pay Rs 5,500 per month to his wife for the cost of the case. The court also directed the husband to pay Rs 500 to his wife for each hearing.
